NEW ORLEANS -- The trial of Will Smiths alleged killer got off to a dramatic start Tuesday, with some of his former New Orleans Saints teammates such as?Drew Brees and Steve Gleason in attendance and his widow, Racquel, testifying for an emotional two hours. At one point, Racquel spoke directly to the defendant, Cardell Hayes, who is accused of shooting her in both legs, then shooting her husband eight times -- seven of them in the back -- following a loud argument between the two men and some of their acquaintances. My worst nightmare happened. For no reason. He didnt have to do that to my baby, Racquel said after detailing the shooting. Then she turned to Hayes and said, And you know it! Or to me. I didnt do you anything.Racquel detailed the two traffic incidents and the loud, profanity-laced shouting match that led up to the shooting. The first was a potential hit-and-run, in which Smiths vehicle may or may not have bumped into the back of Hayes vehicle before driving away. The second came soon after, when Hayes vehicle crashed into the back of Smiths vehicle after he had pursued Smith -- which was either intentional or accidental, according to the competing narratives from the two sides.Racquel admitted that her husband was upset and not calm as he argued with Hayes. But the state stressed that Hayes was the only one of the two who exited his vehicle with a gun in hand.Racquel also acknowledged that she had to calm her husband down, listing the names of their three children and telling him, This is not worth it. But she said Will looked into her eyes, agreed, and they began to walk away before the shooting started.Racquel testified that she heard a pop-pop and didnt even realize she had been shot in the legs until she felt a burning sensation. She said she didnt know how she made her way to the other side of the car and played dead for fear that the shooter might come after her. Then she said she heard another pop-pop-pop-pop-pop and a mans voice yelling, You want to f-in show off for the white boy? [a reference to one of Smiths acquaintances, Richard Hernandez] Look at you now.Racquel said the voice was, loud, angry, evil.Racquel was emotional at times, but also defiant throughout her testimony. In one of her first statements, she referenced that one of the defense attorneys suggested the jury would feel sympathy toward her. And she said, I dont want sympathy. I want justice. She also had two or three terse exchanges with lead defense attorney John Fuller. At one point she said it wasnt the look in her husbands eyes that made her fearful -- it was the eyes of Hayes and his friend Kevin ONeal.Fuller then raised his voice, pointing out that Hayes and ONeal had been calmer than her husband throughout the incident, which didnt make sense if Hayes was supposedly an aggressive killer. And Racquel replied, I saw it in everyones eyes. Im a mother first. Im trying to stop the whole situation because Im scared. It didnt have to go where it went. Everyone on that scene knew it did not have to go that route. The key dispute in this trial will be over which party is considered the aggressor since Hayes is claiming self-defense.The state strongly insisted that Hayes was the aggressor since he crashed into Smiths vehicle at what prosecutors claim was 17-20 mph and was the only one holding a gun.The defense, however, has stressed that Smith and Hernandez were acting erratically and aggressively -- with Smith even throwing punches at Hayes -- before Smith claimed he was going to go to his car for his own gun to, Show you what to do with it.The defense claimed that Hayes did not start firing his gun until after Smith had reached into his vehicle, opened the glove box and began to turn back. And defense attorney Jay Daniels said the law allows Hayes to shoot Smith because he reasonably believed his life was in danger.Cardell acted, Daniels said. He isnt excited about that. But he has a son, he has a family too.The state and Racquel, however, claimed that Smith never went back to his vehicle and was walking away when he was shot. There has not been any evidence presented so far that Smith may have held or fired his own gun. A homicide detective testified that the shell casings on the scene matched the caliber of Hayes weapon -- and the state pointed out that they were all in the vicinity of Smiths vehicle instead of near the vehicle of the man claiming self-defense.However, the defense asked the detective questions about the results of a gun-residue test on Smiths hands, asked about the open glove box in his car and asked about the video evidence of how he was acting at various bars and restaurants throughout the day. Other experts will testify to all of those things as the trial goes on.Smiths gun was found wedged between the drivers seat and the center console. Racquel testified that he normally kept the gun in his glove box. But on that day, he had taken the gun out of his pocket rather than bringing it into the French Quarter festival and quickly reached into the drivers-side door to put it away. The two sides also disagreed on whether or not Hayes was applying his brakes when he crashed into Smiths vehicle -- something experts will dissect later in the trial. And the two sides disagreed on whether or not Hayes had a gun in hand when he first exited his vehicle. The state, however, did not dispute that Smith was intoxicated and said Racquel and the family wished that they were in court for a DUI case instead of a murder trial. And for the first time, the state confirmed that former Saints running back Pierre Thomas was on the scene at the time of the shooting. He had been in a car slightly ahead of the three cars that were involved in the pile-up that preceded the shooting, making a total of at least six people in Smiths party and two in Hayes party.Neither side shied away from Smiths celebrity or prominence as a former star player for the Super Bowl-champion Saints.Assistant district attorney Jason Napoli brought it up right away in opening arguments, saying, We knew Will for defense. Ironically, he died in completely the opposite way. He died defenseless.Daniels, meanwhile, said in his opening statement that Mr. Smiths fantastic football career and charity involvement are not on trial.Fuller also mocked the states overt attempts to pump up Smiths status with the Saints. Former Saints star running back Deuce McAllister -- a close friend of Smiths -- was the first to testify as a character witness. Fuller asked if he was testifying as a famous Saints player and pointed out that the picture the state used for McAllister to identify Smith was an on-field photo in the Superdome with Smith and other players in Saints uniforms.Napoli countered by showing a picture of McAllister and other pallbearers carrying Smiths coffin at his funeral and saying, Is it OK if we take five minutes to talk about what type of person he was?McAllister became choked up while describing Smiths character and the fact that they had children in the same class. He was one of six of Smiths former teammates in attendance, along with Brees, Gleason, Roman Harper, Jahri Evans and Fred McAfee.NMD Cheap .
